Welcome to Francisco Guerrero Photography. By accessing, browsing, or shopping on this Website, you agree to all the terms and conditions in this agreement. Please read them carefully.

Access and Use of the Website

  1. You may only use the Website for non-commercial purposes and in accordance with these Terms.
  2. We may, from time to time, restrict access to certain features, parts or content of the Website, or the entire Website, to users who have registered with us.
  3. If you choose to open an account with us you must ensure that any registration details you provide are accurate. You are responsible for all activities that occur under your account and must notify us immediately of any unauthorized use or other security breach of which you become aware.
  4. We reserve the right to disable any account, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms or if any details you provide for the purposes of registering as a user prove to be false.

Intellectual Property

  1. All content and materials on the Website are the sole and exclusive property of FRANCISCO GUERRERO PHOTOGRAPHY. You may not reproduce, by any means, in full or in part, distribute, publish, transmit, create derivative works based on, modify or sell any such content or materials contained on the Website.
  2. FRANCISCO GUERRERO PHOTOGRAPHY remains the owner of the creations relating to the products displayed on the Website. The Terms and Conditions do not grant you or any other person any entitlements of any kind to the intellectual property rights held by FRANCISCO GUERRERO PHOTOGRAPHY.
  3. These intellectual property rights prohibit the affixing  of  the  FRANCISCO GUERRERO PHOTOGRAPHY photographs and its  logo,  or  the  insertion  of photos of the products or their packaging in any  material, including but not limited to brochures, posters, catalogues, correspondence, press articles, audiovisual works, without express prior written approval from FRANCISCO GUERRERO PHOTOGRAPHY.
  4. You agree to refrain from fabricating and/or arranging for the fabrication of, for itself or on behalf of third parties, products that are identical to, and/or similar to, and/or constituting imitations of the products displayed on the Website or derivative products within the meaning of intellectual property laws and regulations.

Ordering

  1. All orders may only be placed on the Website by customers purchasing for personal or corporate use and not intended for resale.  Any resale of FRANCISCO GUERRERO PHOTOGRAPHY prints purchased on the Website is strictly prohibited. By placing an order you declare and guarantee that you act as a final consumer and that you do not intend to resell FRANCISCO GUERRERO PHOTOGRAPHY products for commercial purposes. 
  2. Your purchase and order of products on this Website constitutes your agreement with FRANCISCO GUERRERO PHOTOGRAPHY to comply with and be bound by the Terms and Conditions.  For each order you place on the Website, your acceptance of the Terms and Conditions is in force as of the date of your order.
  3. FRANCISCO GUERRERO PHOTOGRAPHY reserves the right to cancel your order for any reason without liability if, among other things, the products are not available, are incorrectly priced or are otherwise incorrectly described.  
  4. We make every effort to show you images and descriptions of FRANCISCO GUERRERO PHOtOGRAPHY prints which are accurate and realistic. The images are for illustrative purposes only. We cannot guarantee that a device's display of the colors accurately reflects the color of the FRANCISCO GUERRERO PHOTOGRAPHY prints. Your FRANCISCO GUERRERO PHOTOGRAPHY prints may vary slightly from those images. Sometimes we will need to make changes to our products to comply with laws and regulations, which may mean your FRANCISCO GUERRERO PHOTOGRAPHY print may vary from the description.

Product Availability
  1. Products offered for sale and displayed on the Website are subject to availability of printing paper. FRANCISCO GUERRERO PHOTOGRAPHY shall not be liable in case of stock outage or unavailability of paper.
  2. FRANCISCO GUERRERO PHOTOGRAPHY reserves the right to change the products offered for sale on the Website at any time and without notice.
  3. Should the Product be unexpectedly unavailable, we will inform you by email or by phone as soon as possible.  You will be invited to choose another available product on the Website as substitution for the unavailable product or to cancel your order.   If you cancel your order, you will be refunded in the mode of payment used within ten (10) business days.
Price and Payment
  1. All the prices of the Products published on the Website are expressed in Philippine Pesos and are inclusive of all applicable Philippines taxes but exclusive of shipping cost.
  2. FRANCISCO GUERRERO PHOTOGRAPHY hereby reserves the right to change the price of Products at any time, without prior notice, it being understood that the price charged to the user shall be the one indicated on the Website at the time the order was placed and will not take account of any variations, either increases or decreases, subsequent to the order confirmation.
  3. Payment is due immediately upon confirmation of your order. We accept credit card payments through PayPal.
  4. Online payment transactions are subject to validation checks by your credit card issuer. We are not responsible if your card issuer declines to authorize payment for any reason.
  5. International orders are subject to taxes, exportation permits and/or taxes and importation taxes that may be imposed by the country where your order is to be delivered. For more information click on the Contact Us link in the footer of this Website or email us at info@francisco-guerrero.com.
Shipping and Delivery
  1. Deliveries are made to the address specified in the order form. You are solely responsible for the shipping address provided.
  2. Photograph prints take 3 to five days. Your order will be ready for delivery after this.
  3. Your order will be delivered within 10 working days withing the Philippines and 7 to 21 days for orders outside the Philippines. A tracking link will be sent to you in the Shipping Confirmation email.
  4. Philippine shipping cost is ₱300 for Metro Manila, ₱500 for Luzon, ₱600 for Visayas and ₱900 for Mindanao.
  5. All products within the same order cannot be split and delivered to different addresses.
  6. Deliveries are made by courier Mondays to Saturdays, excluding holidays. It is not possible to specify a precise time at which a delivery will take place. The courier will contact you by SMS or Viber to confirm date and time of delivery. Please note that the courier will require deliveries to be signed for.
  7. International orders cannot be delivered to P.O. Boxes. International orders may be opened and inspected by customs authorities and may be subject to import duties and taxes when the delivery reaches its destination. FRANCISCO GUERRERO PHOTOGRAPHY has no control over any import duties and taxes and cannot predict the amount. We recommend that you contact your local customs office for further information before placing an order. You must comply with all applicable laws and regulations of the country. We will not be liable for any breach by you of any such laws.
  8. In the event of impediments to the delivery due to acts of God, FRANCISCO GUERRERO PHOTOGRAPHY will inform you by e-mail. We will not be held in any way responsible for any delay caused by acts of third parties and/or acts of God.
  9. In the event that the package has evidence of tampering or alteration, do not open the package and contact us immediately at info@francisco-guerrero.com.
  10. In the event of non-delivery to the address specified due to the absence of the recipient, the courier will contact you to reschedule delivery. If these attempts are also unsuccessful, we will follow the procedure below.
    1. The product will be shipped back to FRANCISCO GUERRERO PHOTOGRAPHY.
    2. After thirty days from the date on which the product has been returned to FRANCISCO GUERRERO PHOTOGRAPHY, the contract will be considered as terminated and the purchase order canceled.
    3. FRANCISCO GUERRERO PHOTOGRAPHY will reimburse up to 50% of the amount paid, net of the cost of delivery of the product and the cost of returning the same to FRANCISCO GUERRERO PHOTOGRAPHY. The termination of the contract and the refund amount will be communicated to the user via email. The refund amount will be credited to the payment mean used for the purchase.
    4. In the event that, before the end of the thirty days, you ask to resend the purchased product, you will be charged the cost of returning the product to FRANCISCO GUERRERO PHOTOGRAPHY and the cost of the second delivery.
  11. Delivery is deemed complete when the product is received at the address specified in the order form. This marks the end of the of the sale.
  12. It is your responsibility to check the conditions of the delivered product. Returns, exchanges and refunds will only be entertained within 7 days from receipt of your order.

 Return and Exchange

At FRANCISCO GUERRERO PHOTOGRAPHY, it is our purpose to offer limited edition photograph fine art prints. However, as our products are printed on paper they are very delicate. We also understand that sometimes people change their mind after making a purchase and may wish to return and exchange an item. Please read our policy for returns and exchanges carefully.
  1. Every photograph print is made to order and therefore will not be refunded or exchanged unless they are damaged.
  2. Returned products must be in perfect condition and in their original packaging, together with the purchase invoice or a copy in the case of a partial return. We have sole discretion in determining whether the products purchased are in original condition when returned.
  3. You may exchange an item for another any other item of lesser, equal or greater value.
    1. If you exchange an item for another item of greater value, you will pay the difference in price.
    2. If you exchange an item for another item of lesser value, you will be refunded within 10 business days of receipt of the item returned. and will be done by means of payment in which the order was made.
    3. If you exchange an item, the shipping costs for the first delivery will not be refunded and you will be charged for the shipping costs of the second delivery.
  4. Returns and exchanges should be sent to Acacia Estate, Taguig in the original packaging via courier. Once we receive it we will examine the product’s condition and email you on how to proceed.
  5. Only one exchange per item will be honored.

 

REFUND POLICY

  1. We can process refunds for damaged or defective goods only.
  2. If you receive a damaged or defective item, reply to the order confirmation and state that you will begin a request for a refund. You can attach a photo of the damaged item.
  3. Return the item to Acacia Estate, Taguig in the original packaging via courier. Once we receive it we will examine the product’s condition and email you on how to proceed.
  4. Refunds granted will be made within 10 business days of receipt of the product returned by and will be done by means of payment in which the order was made.

Liability Exclusion

  1. FRANCISCO GUERRERO PHOTOGRAPHY reserves the right to change the Website and its contents at any time without an obligation to notify such change in advance or at a later date.
  2. We cannot and do not guarantee that any content of the Website will be free from viruses and/or other code that may have contaminating or destructive elements.
  3. FRANCISCO GUERRERO PHOTOGRAPHY may update these Terms and Conditions at any time without prior notice by posting them on this Website. You can view the most current version of the Terms and Conditions at any time at the Footer of the Website.
